Introduction

Welcome to Wave - Pray together (the "Service"), operated by Psalm46 Monney, the business entity operating the Wave brand ("we", "us", "our").

By creating an account or using our Service, you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

Article 1: User Account

Account Creation: To use most features, you must create an account. You agree to provide accurate information and keep it up to date.

Security: You are responsible for the security of your password and all activities occurring under your account. Notify us immediately in the event of unauthorized use.

Age Requirement: You must be at least 16 years old to use the Service.

Article 2: User Content

Your Content, Your Responsibility: You are solely responsible for the content (text, images, comments, etc.) that you post on the Service. You must not post content that is illegal, hateful, defamatory, or that infringes upon the rights of others.

You agree to respect the religious beliefs and practices of others.

Ownership: You retain all ownership rights to your content.

Usage License: By posting content, you grant us a worldwide, non-exclusive, and royalty-free license to use, host, display, and distribute that content for the sole purpose of operating and improving the Service.

Article 3: Our Rights and Responsibilities

Modification of the Service: We reserve the right to modify or discontinue the Service at any time, without notice.

Suspension and Account Deletion: We may suspend or delete your account if you fail to comply with these terms, without incurring any liability.

Content Management: We are not responsible for content posted by users. We reserve the right to remove any inappropriate content, including but not limited to:

  • Illegal, hateful, or defamatory content
  • Spam or unsolicited advertising
  • Infringement of third-party rights
  • Sexually explicit or violent content

Users may report problematic content via the reporting feature.

Availability: The Service is provided "as is," to the extent permitted by law. We do not guarantee that it will always be available, secure, or error-free.

Article 4: Limitation of Liability

To the extent permitted by law:

  • We are not liable for indirect, incidental, or consequential damages.
  • Our liability is limited to the amount you have paid in the last 12 months.
  • We do not guarantee that the Service will be free of errors or interruptions.

These limitations do not apply in cases of gross negligence or intentional misconduct on our part.

Article 5: Subscriptions and Payments

Available Plans: The Service offers four plans:

Free: Basic access including the ability to join up to 4 movements, 5 members per created movement, creation of private movements, and all basic features.

Premium:

  • Monthly: 7 CHF/month
  • Annual: 5 CHF/month (60 CHF/year, a 29% saving)
  • Extended access including the ability to join up to 20 movements, up to 15 members per private movement, access to prayer plans, advanced movement features (including chat, prayer requests, export), logbook, Verified Member badge, and a 14-day free trial for new users.

Pro:

  • Monthly: 16 CHF/month
  • Annual: 12 CHF/month (144 CHF/year, a 25% saving)
  • Plan designed for active ministries, including in particular the ability to join up to 40 movements/communities, up to 40 members per private movement, Premium features included, ministry administration, and a readable website link.

Community: The Community plan offers several tiers based on the number of members:

  • Up to 50 members: 35 CHF/month or 29 CHF/month (348 CHF/year)
  • Up to 150 members: 65 CHF/month or 49 CHF/month (588 CHF/year)
  • Up to 400 members: 120 CHF/month or 89 CHF/month (1068 CHF/year)
  • Up to 1000 members: 220 CHF/month or 169 CHF/month (2028 CHF/year)
  • Plan for organizations including the creation and management of a community, member management according to the selected tier, Premium features, priority support, and a Founding Member badge.

Prices and Payment: Prices are indicated in CHF. Payment is made monthly or annually depending on the chosen plan, via credit card or any other payment method offered on the Service.

Trial Period: The Premium plan includes a 14-day free trial for new users. You can cancel at any time during this period at no cost. At the end of the trial period, your subscription will be automatically activated and billed.

Automatic Renewal: Unless canceled by you, your subscription automatically renews each month or year depending on the chosen plan. You will be billed at the beginning of each billing period.

Cancellation: You can cancel your subscription at any time from your account settings. The cancellation takes effect at the end of the current billing period. No refunds are provided, except in the case of a technical error on our part or in application of legal withdrawal rights.

Payment Failure: In the event of a payment failure, we will notify you by email. You have a period of 7 days to regularize your situation. After this period, your subscription will be suspended, and your features limited to the Free plan.

Payment Processor: Payments are processed securely by Stripe Inc. We do not store your banking information. For more information, please see Stripe's policy.

Price Modifications: We reserve the right to modify our rates at any time. We will inform you by email at least 30 days before any price increase takes effect. If you do not accept the new pricing, you may cancel your subscription.

Access After Termination: In the event of a downgrade from a paid plan to the Free plan, your data remains accessible within the limits of the Free plan. Premium features will no longer be accessible.

Article 6: Privacy Policy

By using our services, you agree to our Privacy Policy.

Article 7: Termination

In principle, you may choose to delete your account at any time. However, if you are the founder of a group, you must first transfer ownership of the group or delete it. When you delete your account:

  • Your personal data (name, email, profile picture) is anonymized immediately.
  • Your public content (prayer requests, cards) remains visible but anonymized ("[Deleted Account]").
  • You may request the complete deletion of your content by contacting us before deleting the account.

Article 8: Intellectual Property

The name and logo of Wave - Pray together are our property.

Article 9: Modification of Terms

We may modify these Terms at any time. We will inform you by email or via an in-app notification. By continuing to use the Service after a modification, you accept the new terms.

Article 10: Governing Law

These Terms are governed by Swiss law. Any dispute shall be subject to the exclusive jurisdiction of the courts of the Canton of Vaud, Switzerland.
